Jimmy John’s Receives FDA Warning About Contaminated ProduceThe U.S. Food and Drug Administration (FDA) sent a warning letter to the sandwich restaurant chain Jimmy John’s, claiming that the franchise has repeatedly purchased adulterated produce. The FDA identified sprouts and cucumbers as the adulterated products and cited five outbreaks of E. coli or salmonella linked to the restaurants since 2012. Though Jimmy John’s removed sprouts from its stores as a precautionary measure, the FDA said the franchise needs to take corrective action to prevent such outbreaks from continuing to occur. E. coli and salmonella infections can be potentially fatal to young children, older adults and people with weakened immune systems.

What Is Adulterated Produce?

Adulterating food normally refers to adding or replacing ingredients in a food product that may cause harm to those who consume it. For instance, a food manufacturer may replace a natural ingredient in its product with an artificial one, which causes people to become sick upon eating it. In the Jimmy John’s case, the E. coli and salmonella are not artificial ingredients but poisonous substances that have contaminated the produce. Though the producer did not intentionally add the contaminants, it still meets the legal definition of adulterated because there is enough of the contaminant to cause harm.

History of Outbreaks

The FDA accused Jimmy John’s of lacking the control mechanisms to prevent it from continuing to purchase contaminated produce. As previously referenced, the FDA cited five recent food poisoning cases:

Cut Fruit Causes Salmonella Outbreak in 11 StatesSalmonella is one of the most common sources of food poisoning in the U.S. The Centers for Disease Control and Prevention (CDC) estimate that 1.35 million people receive salmonella infections each year, which leads to 26,500 hospitalizations and 420 deaths. People most often associate salmonella with eating raw or undercooked meats. A CDC study published in 2011 found that 67 percent of the salmonella outbreaks came from poultry, eggs, pork, and beef. However, salmonella bacteria can contaminate any food, including fruits and vegetables.

Cut Fruit Tied to Recent Outbreak

Tailor Cut Produce recalled several cut fruit products on Dec. 7 because of the risk of salmonella contamination. The products included:

  • The Fruit Luau cut fruit mix
  • Cut cantaloupe
  • Cut honeydew melon
  • Cut pineapple

According to the CDC, the salmonella outbreak is believed to have infected 96 people from 11 states – including one person from Illinois. Twenty-seven of those patients were hospitalized, and there are no reports of related deaths. Tailor Cut Produce sold the fruit to food service companies that served it to patrons in schools, hospitals, and hotels. In this case, a victim would seek compensation from the original seller of the contaminated fruit and not the institution that served the fruit – unless that institution still served the fruit after learning about the recall.

Salmonella Outbreak

According to the Center for Disease Control an outbreak of salmonella has spread across the United States. NBC news reports that this particular strand of salmonella bacteria has shown itself to be resistant to the typical antibiotics that are used to treat such infections. So far 92 people have been infected across multiple states, although only 21 people were ill enough to be hospitalized.

The Centers for Disease Control observed a peculiar strand in live chickens as well as raw poultry meat. However, no specific store or source has been singled out as spreading the foul chicken meat to the public at large. Thus, public health resources have been unable to direct consumers away from the contaminants.

JBS Salmonella Newport Outbreak Reaches 22 States, 120 Cases Reported

A recent Salmonella outbreak has touched the lives of many individuals across the the United States. As of October 4, 2018, 27 people across 16 states had been infected by the illness. Six more states - Oklahoma, Texas, Hawaii, Kansas, New Mexico, and Washington - have reported cases of the illness since then, with the number of impacted individuals rising to 120 as of October 23, 2018.

Fortunately, there has not been any loss of life even though 33 people have been hospitalized. The outbreak began in early August, 2018 and the average age of people who have fallen ill is reportedly 42; 59% of affected individuals are male.

As part of the investigation, state and local health departments officials interviewed ill people about their food intake and exposure in the days preceding the illness. Out of 71, 66 individuals (93%) reported eating ground beef at home as per the interview.

Jimmy John's Salmonella Outbreak

A woman filed the first lawsuit against Jimmy John's Gourmet Sandwiches after she developed a Salmonella Montevideo infection after consuming the sprouts within her sandwich. The woman alleges she had purchased the #12 Beach Club Sandwich on December 18, 2017 and experienced severe discomfort soon after its consumption.

On January 8, 2018, the plaintiff sought medical attention, where the lab tests returned as positive for Salmonella Montevideo. Later, she went though unique stages of the infection. She was repeatedly given antibiotics to treat different problems, but she did not recuperate from the severe contamination. She started experiencing nausea, painful diarrhea, and stomach cramps. Later, she even started to develop hemorrhoids along with a urinary tract infection.

On January 19, 2018, the Centers for Disease Control and Prevention reported a multi-state outbreak of Salmonella Montevideo infections from Jimmy John's raw sprouts. CDC further announced 10 confirmed cases across Illinois, Minnesota, and Wisconsin where the woman who brought the lawsuit was one of the 10 confirmed cases. Symptoms of Salmonella may include headache, muscle aches, diarrhea, vomiting, abdominal cramping, chills, fever, nausea, and dehydration.
